Terms and conditions

The users and people who wish to use Isissimo, will have to agree with the terms and conditions stated below.

Scope of terms and conditions 

Article 1

The scope of terms and conditions includes information stated in the website and e-mail that we send.

Registering in our service

Article 2

The user will agree with the conditions, and then register for the service. After registration, the user should check if the things listed below are done.

1. Register after agreeing to the terms and conditions of the service.
2. Installation of Skype
3. Please input correct information on fields with red mark (name, e-mail address, password, & etc.) The user is liable for the information inputted.
4. Check if your connection stability will not interfere if in use of our service.
5. There will be a need to have an authorization from parents, & etc. if the user is a minor.
6. Have the lesson plan with the payments method listed by the company.

Restricted acts

Article 3

If ever the user have commited an act listed below, the company will delete the user’s account, set legal action, & etc.

1. If the user sold rights, transfer, trade, ot change the name of the company service.
2. Infringement of company’s name and trust
3. An act against the law
4. An act that could disturb our service operation
5. An act related to crime
6. Any other form of harassment towards that teacher that results to difficulty in resuming the lesson. We will confirm about the harassment base on our judgement.
7. Inquiry to teacher’s working condition, internet connection and other information that are not revealed.
8. An act of having contact through e-mail with the teacher either in online or offline.
9. An act of suggesting other companies to the teacher
10. An act of using one account with numerous users
11. An act wherein the user who has several accounts will book a class then cancels it, then books it again using another account
12. An act of cancelling an extra lesson (a lesson which was booked with the use of transfer ticket)
13. And other inapporopriate acts

Unrecognizable registration/cancellation

Article 4

If the cases are the ones written below, and we are unable to recognize the registration, we could cancel the user’s registration. We would not be refunding the payment for cases like these.

1. Non-existence
2. There is an error upon registration
3. If the user has already an existing account
4. If the past registrations has been deleted.
5. If the user doesn’t have the ability to pay
6. If the previous account was was unpaid
7. And other reasons in which the company decides to have the user’s account deleted

Changes in Terms and conditions

Article 5 

The company has the right to take changes in the terms and conditions. After the changed terms and conditions has been shown in our website, the user should accept and follow the changes.

Changing of registered information

Article 6

If there are changes in the information that you have registered, the user should edit the changes. The changes in the informations will be the user’s liability.

Handling of registered information 

Article 7

Section 1. We will be handling the user’s personal information according to the privacy policy. There are cases that the personal information will be needed by the third party website

1. If the user agrees to it
2. If the company were required to disclose to the public institution by the laws and regulations
3. If the user has posted on the reservation page of the service where the nickname has been registered in alphabet letters

Section 2

The user should carefully manage the information registered. It is assumed that when user forgot the registration information, it will be the user’s responsibility  and the company is not liable for it. If the user knows that the registration information has been exploited by others, the user should contact it to the company immediately.

Recession • Withdrawal

Article 8

Section 1

1. Withdrawal of account can be done with a certain process. As the user contact the office for withdrawal of account, there will be no payment afterwards. After the withdrawal, user will lose all the rights of service and a request related to the company.
2. After the withdrawal of account, there will be a need to re-register if the user wishes to use the service again.

Section 3

If user have recessed or withdraw their account, their option service will be suspended as well.

Service Regulations

Article 9

The users should agree with the terms listed below before using our service.

Section 1

The user can pay the lesson fees with the methods listed below.

1. Pay the 1-month payment thru credit card

Section 2

1. After the user have paid the monthly fee using method number 1, if the user did not proceed with the withdrawal procedure it will be assumed that the user will continue to use the service also for the next month and it will automatically be renewed.

Section 3

After the user have paid the monthly fee using either of the methods mentioned above,you will have to send an e-mail and proceed with the procedures needed to continue using the service and pay within 30 days to continue using our service.

Section 4

We will be refunding the user’s payment for conditions listed below.

1. After paying with the method of Section 1 number 1, in accordance with the provision,  8 days after we have confirmed through e-mail the payment of the user we will be refunding (with a deduction of 1000 yen) the payment if the user wishes to withdraw within the said date. If you have other account with the same credit card or same user name, you will have to cancel within 8 days as well.
2. After paying with the method of Section 1 number 2, in accordance with the provision, 8 days after we have confirmed through e-mail the payment of the user we will be refunding (with a deduction of 1000 yen) the payment if the user wishes to withdraw for 3 months paid.

Section 5

For the company to be able to provide a quality service to the users, we will be recording the user’s personal information

Section 6

In order to for the company to render a smooth service for the users, there will be times that there will be a need for observation. Please do agree that there will be times that some of the lessons will be observed.

Section 7

The users should be aware that the possible number of bookings are limited. The maximum number of possible lesson booking is 2 and also 2 for the number of bookings allowed in a day. If the user uses the early morning lesson plan, the user is allowed to have 1 lesson a day between 6:00 am to 10:00 am (Japan time).

Section 8

If the user will be booking with the use of the transfer ticket, the user is allowed to book 2 itmes at a time, and 2 lessons as well for a day. If in case the user have canceled a lesson that is booked by the use of the transfer ticket, it will be counted as “used”.

Duration of Service rendered 

Article 10

Section 1

The user can avail our service by the day that he/she agreed to the terms and conditions of the company.

Section 2

The user will be withdrawed for conditions written in article 4 & 8. However, for article 4 the company will decide when the user will withdraw, while for article 8 the last date of usage will depend on the due date of the month.

Suspension/Termination of service

Article 11

Section 1

For suspension or cancellation of service, we will be announcing it ahead or after through the official website or e-mail address. We will be suspending in case of Skype interruption, natural calamity,or any other reasons that the company cannot handle.

Distribution of information

Article 12

The company will be relaying announcements, advertisements, and surveys to the users through e-mail.

Using Skype

Article 13

The service that the company provides uses Skype. The users should agree with the conditons written below.

1. The user should follow the terms and conditions indicated by Skype.
2. It is the user’s responsibility to download the software and check if it’s working before using the company’s service.
3. If the user’s hardware broke down and the user wouldn’t be able to use skype, the company will not be responsible for it.
4. If the skype malfunctioned after the class, the company will not be responsible for it.
5. If the user experienced trouble with skype information, the company will not be liable for it. We also do not accept inquiries regarding skype services.

Limitation of liability

Article 14

The user agrees that the company is not liable for the reasons listed below.

1. If you have used the service, or haven’t used the service.
2. If there’s an illegal access in sending or data or any other changes has been made.
3. An act of transmitting or receiving fom a third-party while using our service.
4. Learning effect of the service
5. If there is a damage in case the user has told an important information during the lesson.
6. If the user was unsatisfied with the lesson with the reasons listed below:
   1. For a condition in which there is a sudden increase of students or internet connection trouble in the Philippines and the user was unsatisfied with one of the lessons.
   2. When the user cannot book for the time he/she wishes to have the lesson
   3. If the user cannot book a certain teacher
   4. In case wherein there’s electricity shortage or internet connection interruption in the Philippines.
7. Other matters related to the service

Copyright and ownership rights

Article 15

Copyright trademark for the service, logo, description and such, are all property of the company. The company forbids the user to use these without the permission of the company.

Governing Law and exclusive jurisdiction court

Article 16

The laws applicable in the agreement will be the laws that are governed by Japan.  In addition, the exclusive jurisdiction of the Tokyo District Court will be handling for the  disputes that may arise between the user and the company in relation to the terms or service.

PRIVACY POLICY
In Isissimo, we are very careful in handling personal information that are listed upon registration.
Please input your personal information by reading first our “Personal information protection and policy”.

1. Personal Information
We will be needing some of personal information including name, gender, birthday, postal code, address, telephone number, e-mail address. These personal information will be used upon registration in our website.

2. Protection and handling of personal information
We take all the necessary preventive measures to protect the private information of users.

3. Gathering of personal information
To use our service, we will need to have some personal information of the user. Access history will be recorded in our website.

4. Use of your personal information
We will only use the user’s personal information for the things listed below.

1. To let the users know if there are information that will be affected in using our service
2. To assist the user in case of trouble
3. In accepting service payments
4. For confirmation to the user itself

5. Distribution of service information
For registered users, we will be distributing different e-mails (news letters, campaign information, surveys)

6. Handling and sharing of personal information
We wouldn’t share the user’s personal information to a third-party website. Following are the exceptions.

1. The user approved to have it shared.
2. If the user have made a violation against the rule and need to take a legal action against it.
3. If there was a case held by the judgement or police and they ordered to have user’s information.
4. If the information is needed immediately (dangerous times).
5. If the user itself shared the information.

7. Editing and deleting personal information – Withdrawal of service usage
It is possible to have changes for the personal information. Personal information should be true and it is the user’s liability. We wouldn’t change the user’s information with their consent. If you wish to stop using our service, we will stop using our personal information. I you wish to delete your personal information, please contact us by proceeding to withdrawal of account. We will be contacting the user for instructions for withdrawal of account.

8. Changes in plan on protecting one’s personal information
If there will be change in handling the personal information, we will be announcing it through our website beforehand.

9. Usage of personal information due to advertisement
There are cases wherein third-party website like Yahoo will be needing the user’s cookie. The cookie that was encrypted upon the third party website will undergone through their private policy as it is also possible for the user to access in the third-party website page and delete the cookie which contains personal information.

Whenever the user uses a website thru a browser or server the inputted information will remain in the history of the user’s computer. It is also possible in accessing the same page to use the information in cookie. If in the browser settings of the user’s website allows, the website can acquire the cookie with. For privacy purposes, the cookie that was sent through the website will be the only cookie to be sent.

The user can choose from the settings with “allow all cookies” “do not allow all cookies” and “notify when a cookie is received”. Settings will depend on the browser used. Please check your browser settings by going to help in the menu bar. Please take note that if your chose the option “do not allow all cookies” there is a tendency that the user would not be able to access to some of the websites related to our service.

10. Personal contact with the teacher
We do not allow the users to get in touch personally with our teachers outside their working hours be it online or offline. If a user have kept in touch with the teacher personally, and a personal information was leaked, the company will not be liable for it.
